Construction, Ownership & Operating Agreement

The 1999 model is a revised version of a model finalized in 1996. It provides for the construction, ownership, and operation of a broad range of facilities.

The final model agreement retains the three part format of the first draft, including a Head Document, Operating Procedure and Appendices section. The Head Document covers the major business issues along with items unique to the subject facility, the Operating Procedure contains standardized provisions with elections or fill-in-the-blanks where appropriate, and the Appendices contain technical and administrative provisions which may require revision from time to time. The flexibility provided by this format allows the agreement to be used for simple or complex facilities.
